1. Definitions
1.1 The gym: GYM24
1.2 Gym rules: The rules and regulations of the gym. These are outlined in the terms and conditions and can be provided thereafter upon request
2. Membership terms
2.1 Once you have joined GYM24, you will be sent a Welcome email to confirm your membership. Please read this carefully
2.2 Your membership and this agreement are not transferable. You may not transfer your membership to anyone else, even temporarily
2.3 Sharing access details will result in immediate membership cancellation with no refund and you cannot
bring anyone into the gym who is not a member
2.4 You will only be able to use the gym if your membership is current and fully paid up or if you have made payment arrangements acceptable to the gym
2.5 Members must be 16 years or older
2.6 By agreeing to these terms and conditions, you agree to comply with our membership rules
2.7 The gym reserves the right to change our membership rules at any time
3. Health declaration
3.1 You must complete a PAR-Q (health declaration) before you can start training in the gym – this will be available to complete in the Member Area online and this information will be kept private and confidential at all times
3.2 The team at the gym will strive to support you on your fitness journey however we would ask that you are mindful of your own personal training abilities at all times and ask you not to exercise beyond what you consider to be beyond your own abilities
3.3 If you have any concerns with your health or fitness, you should seek independent medical advice before engaging in any physical activity in the gym
3.4 The gym will strive to ensure the gym and all equipment are safe to use at all times and that our staff and trainers are qualified to industry standard
3.5 To the best of your knowledge and belief, you are in good health and not knowingly incapable of engaging in either passive or active exercise and that such exercise would not be detrimental to your health, safety, comfort or physical condition
3.6 You must advise us immediately should your health or vulnerability to injury change
4. Inductions
4.1 Your safety is our utmost priority and as such we strongly recommend all members have an induction before starting training in the gym to ensure you are familiar with the gym, the facilities and how to use all of the equipment safely, and correctly. You can contact the club directly to book an induction or book a slot on our app
4.2 GYM24 will not accept any claim or liability for any personal injury incurred from using the gym’s facilities or equipment if you have opted out of having a comprehensive induction with a member of the team
4.3 If you do not know how to use a piece of equipment, you must seek advice from a qualified member of staff before using
4.4 If you choose not to book an induction with our team, you warrant, declare and acknowledge that you are an experienced gym user and have opted out of induction training
5. Payment
5.1 Once you’ve signed up, you will pay your first month upfront then go onto a rolling monthly contract
5.2 Your monthly membership fee will be taken on the same day each month and will extend your membership of GYM24 for one month
5.3 Joining fees and monthly fees are non-refundable under any circumstances outwith Covid-19 restrictions which would require the gym to close. We will communicate with you directly on this
5.4 If you default on your monthly payment, you will be charged a fee of no more than £15 for failed payment. It is in your best interest to ensure this does not happen so please ensure there are always funds in your account to cover your monthly membership fee
5.5 The gym reserves the right to review our membership fees however your fee will never increase whilst your membership agreement is in place. For any changes to monthly contracts, the gym will give you at least 30 days’ notice
5.6 We will not be liable or responsible for any outstanding monies paid to a personal trainer. Personal training is arranged directly with the PT and not the gym
6. Cancellation of membership – termination by the gym
6.1 The gym reserves the right to cancel your membership if you breach any gym rules
6.2 The gym may cancel your membership if you provide us with any details you know to be false when the information may have reasonably affected our decision to grant you membership
6.3 Your membership will be cancelled immediately if you share your access details or if you bring anyone
into the gym who is not a member
6.4 If the gym waives any breach of this agreement, we have the right to enforce the terms of the agreement at a future date
7. Cancellation of membership – termination by you
7.1 If you choose to leave the gym, and are on a rolling contract, your membership will remain in force until the day before your next payment is due, at which point it will automatically terminate. You must notify us by email to cancel your membership giving at least 5 days notice to team24@gym24wishaw.com
7.2 You may terminate this agreement if you are unable to use the gym through serious illness or injury – we may request a doctor’s certificate to support this
7.3 You may also terminate the contract if we change the location of the gym, permanently reduce the facilities or opening hours, or close for a refurbishment of more than 30 days
7.4 You are entitled to cancel your membership and receive a full refund of any fees paid within 14 days of signing up. However, if you request to start your membership early, you agree that if you then cancel your membership within the 14 day period, you will be refunded any monies paid, less an amount for the membership you have already used commencing from the first day after joining.
8. Suspension of membership
You can put your membership on freeze if you are unable to make use of the facilities due to extenuating circumstances for a continuous period of 1 month and a maximum of 6 months. This could include serious illness or injury, relocating or loss of income. The gym reserves the right to request proof ie. a doctor’s certificate. A nominal monthly charge may be applied depending on circumstance.
9. Gym rules
9.1 The gym is monitored by CCTV 24/7 to ensure the safety and security of our members and staff
9.2 Personal security devices are available out of hours and must be worn – and must only be used in the case of an emergency
9.3 For safety reasons, bags are not allowed on the gym floor – lockers are provided for your personal belongings
9.4 You must respect and be mindful of other gym members and put your weights away and clean kit after use. Any breach to this could lead to your membership being cancelled
9.5 You must not behave in an aggressive, abusive, inappropriate, anti social or threatening manner to any staff member or fellow gym member – anyone doing so will immediately have their membership cancelled
9.6 Smoking, including e-cigarettes, is strictly prohibited within the gym and you may not use the gym under the influence of alcohol, narcotics or any other substance that may affect your ability to exercise safely
9.7 The gym may change its rules from time to time in order to ensure the health and safety of members. Temporary amendments will be displayed within the gym and members will be notified by email
9.8 Permanent changes to the gym rules will only be made after at least 30 days’ notice to members, except in the case of emergency
9.9 The gym reserves the right to adjust the availability of certain facilities or close the gym on a temporary basis for the general purpose of cleaning, decorating, essential repairs or maintenance of equipment
10.You must wear a top in the gym at all times. The Stretch Studio can be used for posing when it is not in use.
10. Health & Safety
Members must read all Health and Safety notices displayed in the gym and comply with their recommendations.
11. Sale of Club
In the event of the sale or disposal of the gym to another company or to any other person we may transfer your membership to the new owner; you will continue as a member of the gym and continue to pay your membership fees provided no changes to these terms or the gym rules having a material adverse effect on your use of the gym are made by the new owner. Any such disposal will not affect your contractual or statutory rights.
12. Notices
Notices from you to the gym must be in writing and addressed to the general manager at the gym. The gym reserves the right to require evidence of posting or delivery where it has no record of receipt or the date of any notice appears inconsistent with the date of receipt. In these cases the notice will be deemed not given unless such evidence is produced. Any notice handed to the gym must be receipted. Notices from the gym to you will be posted to you at your address in the membership records (or, where these terms permit, displayed on notice boards at the Club).
Disclaimer
1. Neither the gym nor the employees or agents of the gym shall be liable for any loss, damage or theft of personal property belonging to the member occurring on the gym premises
2. Neither the gym, nor its employees or agents shall be responsible for any injury occurring on the gym premises as a result of misuse of the facilities and/or equipment provided by the gym
3. Members or guests who have concerns about their health should discuss this in advance with the gym prior to joining/training
